What is wrong is that financial liability waiver (though it does not entirely protect the promoter and fair grounds) that you sign before you compete. You, the driver, knowingly (and financially) entered into an event with a vehicle prepared by yourself where MINIMUM (keyword) safety requirements are listed and posted in public venue. Said safety requirements are NOT limited to those listed as you personally may go farther to ensure your safety by providing yourself a halo/rollover bar which is also listed in the rules in public venue as optional. Your CHOICE to compete without one falls into a category called "Percent Negligence" What percentage of the accident is the driver's fault for not having a halo bar when it was allowed by the rules? What percentage is the promoters fault for not making halo bars manditory? What percentage is the venues fault for not ensuring the safety of its performers? Etc. That percent negligence, as horrific as this accident was, is much higher on the driver than the promoter or venue.
That is law, and how it will play out if it went to court, which it won't. It'll get settled out of court if it even goes that far. You have to look at the precedence before it. How many times has it happened in the sport before? How many deaths resulted from it? How many serious injuries? How many minor injuries? How many of those are documented? A defense lawyer can tear this lawsuit apart.
All that said, I simply don't run without a halo bar anymore. Once I flipped years ago, that was the last time without one.

THEY ALWAYS LIKE TO MAKE AN "EXAMPLE" OUT OF THE FIRST CASE OF A CERTAIN TYPE, AND IT DOESNT GO VERY WELL FOR THE DEFENDANTS..... AS A PROMOTER WHO IS INVOLVED IN MOTORSPORTS WHERE THINGS ARE INTENTIONALLY DESTROYED, I WOULD MAKE darn SURE THAT THE DRIVERS WHO PUT ON A SHOW, ARE AS PROTECTED AS THEY CAN BE FROM ANY SITUATIONS THAT COULD/CAN/WILL/ARE LIKELY TO OCCUR. WITH DERBY ICONS ADVERTISING THAT THEY PAY A "BONUS CASH AWARD" FOR HEAVY HITTERS, AN ATTORNEY COULD SURELY SHOW NEGLIGENCE ..... TORY AND DAVE ARE IN A VERY ACTIONABLE POSITION....... I WOULD ASSUME THE 2 YEARS STATUTE OF LIMITATIONS FOR A WRONGFUL DEATH- INJURY, WOULD COME INTO PLAY.. MANY FAMILIES WAIT TO GET THEIR DUCKS IN A ROW BEFORE FILING A LAWSUIT AT THE LAST DAY ALLOWED. DONT BREATH EASY JUST YET........

It looks like they just pulled the Icon Instigator award from DI shows. The claim is after a review of the insurance it is not allowed. Watch for the main to be 5 hours now. I guess the engine builders better start finding a way to make their engines more fuel efficient.

YOU ARE RIGHT RICK, ITS MY NEW GOAL. I HAD MORE FUN LAST YEAR RUNNING A 3 DAY BUILD WIRE CAR THAN THE WELDED UP SLED I TOOK 8 MONTHS TO BUILD. NO STRESS WITH THE WIRE CAR, WAS A BLAST JUST JUNKING ANYTHING IN FRONT OF ME WITHOUT CARING ABOUT WHAT WAS GETTING DAMAGED... JUST LIKE THE GOOD OLD DAYS BEFORE MONEY RUINED IT ALL..........
